Terms & Conditions

These Terms and Conditions ("Terms") govern your access to and use of the Mavek website (mavek.ai) and the Mavek marketing execution platform ("Service"). By accessing or using Mavek, you agree to be bound by these Terms. If you do not agree, do not use the Service.
1. Definitions
- "Mavek," "we," "us," "our" refers to the entity operating the Mavek platform at mavek.ai.
- "User," "you," "your" refers to any individual or entity accessing or using the Service.
- "Service" refers to the Mavek website, platform, tools, APIs, and all related features.
- "Content" refers to any text, images, data, campaigns, or materials created, uploaded, or processed through the Service.
2. Eligibility
You must be at least 18 years old and have the legal capacity to enter into a binding agreement to use Mavek. If you are using the Service on behalf of an organization, you represent that you have authority to bind that organization to these Terms.
3. Account Registration
- You are responsible for maintaining the confidentiality of your account credentials.
- You agree to provide accurate and complete information during registration.
- You are responsible for all activity that occurs under your account.
- Notify us immediately at donna@mavek.ai if you suspect unauthorized access.
4. Subscription Plans & Billing
- Mavek offers subscription plans (Starter, Growth, and Enterprise) as described on our Pricing page.
- Subscriptions are billed on a monthly recurring basis unless otherwise agreed.
- Prices are subject to change with 30 days' notice. Existing subscribers will be notified before any price change takes effect.
- All fees are exclusive of applicable taxes unless stated otherwise.
5. Cancellation & Refunds
Cancellation and refund terms are governed by our Refund and Cancellation Policy. In summary:
- You may cancel your subscription at any time. No lock-in contracts.
- Cancellation takes effect at the end of the current billing cycle.
- Your data and campaign history remain accessible for 30 days after cancellation.
6. Acceptable Use
You agree not to use Mavek to:
- Violate any applicable laws, regulations, or third-party rights.
- Send spam, unsolicited bulk messages, or deceptive communications.
- Distribute malware, phishing content, or fraudulent material.
- Scrape, crawl, or extract data from the platform for unauthorized purposes.
- Interfere with or disrupt the integrity or performance of the Service.
- Circumvent security measures, authentication mechanisms, or access controls.
- Use the Service in a manner that could harm Mavek's reputation or other users.
We reserve the right to suspend or terminate accounts that violate these terms without prior notice.
7. Your Data & Content
- You retain ownership of all data, content, and materials you provide to Mavek.
- You grant Mavek a limited, non-exclusive license to use your data solely to provide and improve the Service on your behalf.
- We do not sell your data to third parties.
- You are responsible for ensuring you have the right to use any data or content you connect to the platform, including third-party marketing data and integration credentials.
8. Intellectual Property
- The Mavek name, logo, brand identity, platform design, and all proprietary technology are owned by Mavek and protected by intellectual property laws.
- You may not copy, modify, distribute, or reverse-engineer any part of the Service without written permission.
- Content generated by Mavek on your behalf (ad copy, email drafts, SEO content, etc.) is yours to use for your business purposes.
9. Third-Party Integrations
Mavek connects with third-party platforms including Google Ads, Meta Ads, LinkedIn, HubSpot, Apollo.io, Google Analytics, and Search Console. By authorizing these integrations:
- You agree to the respective terms of service and privacy policies of each platform.
- You authorize Mavek to access and manage data within those platforms as necessary to execute your campaigns.
- Mavek is not responsible for downtime, data loss, or policy changes by third-party providers.
10. Approval Gates & Liability
Mavek operates with approval gates by default. No campaign, ad, or outreach goes live without your review and approval. If you enable auto-approve for certain workflows:
- You accept responsibility for content published through auto-approved workflows.
- Mavek will apply its quality safeguards, but final accountability for published content rests with you.
11. Service Availability
- We strive to maintain high uptime but do not guarantee uninterrupted service.
- Scheduled maintenance will be communicated in advance when possible.
- We are not liable for service interruptions caused by factors beyond our control (force majeure, third-party outages, internet disruptions).
12. Limitation of Liability
To the maximum extent permitted by law:
- Mavek is provided "as is" without warranties of any kind, express or implied.
- We do not guarantee specific marketing results, revenue increases, or performance outcomes.
- Our total liability for any claim arising from the Service shall not exceed the amount you paid to Mavek in the 12 months preceding the claim.
- We are not liable for indirect, incidental, consequential, or punitive damages.
13. Indemnification
You agree to indemnify and hold Mavek harmless from any claims, losses, or damages arising from your use of the Service, violation of these Terms, or infringement of any third-party rights.
14. Governing Law
These Terms are governed by and construed in accordance with the laws of India. Any disputes shall be subject to the exclusive jurisdiction of the courts in India.
15. Changes to These Terms
We may modify these Terms at any time. Material changes will be communicated via email or through the platform. Continued use of the Service after changes constitutes acceptance of the updated Terms.
